Corporate Transparency Act Update
On December 26, a federal appellate court ruled to halt the beneficial ownership reporting requirements until the court hears and rules on the case challenging the Corporate Transparency Act (CTA). Currently, most business owners are not required to report their beneficial owners to the FinCEN database. Stay tuned for further updates.Cryptocurrency Outlook
President Trump courted the cryptocurrency community on the campaign trail with promises to deregulate crypto. Time will tell whether the incoming administration can reshape the financial landscape with crypto-friendly policies. Crypto advocates hope the federal government will reduce regulatory barriers to virtual currency. For instance, advocates would like the SEC to stop classifying all tokens as securities, arguing that clearer definitions will spark innovation and investment. The crypto community is also pushing for rules that allow banks to partner with crypto companies and enable services like loans and payment processing. Another desire is to simplify anti-money laundering requirements for crypto platforms, making integrating cryptocurrency into traditional finance easier. The debate over whether crypto is a currency or an asset continues, but the IRS firmly classifies virtual currency as property for now. The IRS taxes crypto like marketable securities, applying long- or short-term capital gains or losses based on holding periods. Some lesser-known taxable events include selling crypto for dollars, exchanging one cryptocurrency for another, or using crypto to pay for goods and services. Investors can use losses to offset gains from other property transactions. Unlike securities, crypto transactions avoid "wash sale" rules, providing more flexibility for tax strategies. Properly managing cryptocurrency ensures you maintain access to these valuable assets. Many individuals have lost significant sums by forgetting passwords or private keys. If you hold crypto on platforms like Coinbase or other exchanges, securely prioritize duplicating password storage. Estate planning for cryptocurrency also demands careful preparation. Executors need clear instructions to access and distribute crypto assets. Options like creating a trust or using a "dead person’s switch" app, which delivers passwords to an executor after death, help ensure a smooth transfer of assets.
